By completing the registration process, you fully understand and agree to all the terms herein. Your agreement and compliance with these terms signify your ability to comprehend them and make informed decisions. If you do not agree with our guidelines, please refrain from registering or using our services. IceCreamTutor reserves the right to cease providing services to any member.
Limitations
Welcome to IceCreamTutor! Prior to registration, all members are required to review the explanations provided in the “Terms of Use.” Below are the terms and rules that members must adhere to while using the IceCreamTutor website and its services. Upon completion of the registration process, you signify your acceptance of these terms and rules. IceCreamTutor may revise the terms at any time, with such revisions posted on this website. Revised terms will automatically take effect seven days after posting. Therefore, members should regularly check the IceCreamTutor website for any changes to the terms. Continuing to use the website or services after any changes to the terms indicates acceptance of those changes.
Definitions
1.1 Definitions
– “Member” includes but is not limited to parents, students, and teachers, and all platform users.
– “Membership Terms” refer to any part of this website’s guidelines, instructions, content, terms, or explanations, all of which constitute part of the membership terms. Successful registration implies agreement to all terms.
– “Site” refers to the IceCreamTutor website and its affiliated websites and mobile applications.
– “Deceptive Behavior” refers to the falsification of information or fraud by members during registration.
1.2 Headings
Headings within these terms are for convenience only and do not constitute part of the content. They do not affect the interpretation of these terms or any part thereof.
IceCreamTutor Responsibilities
1.3 Role as a Matching Platform
IceCreamTutor operates as an online matching platform, solely responsible for providing a platform for teachers and parents or students to match independently for private tutoring services. There is no contractual cooperation between teachers and parents or students, nor any employment relationship. Members and IceCreamTutor have a service provider and service user relationship, with no employment ties.
1.4 No Guarantee of Reasonableness of Requests
IceCreamTutor explicitly states that it does not conduct interviews or home visits with parents or students beforehand, and it does not control the legality, appropriateness, or other principles of tutors’ morality, academic qualifications, character, teaching quality, or standards, which are outside the control of IceCreamTutor.
1.5 No Guarantee of Members’ Personal Safety
IceCreamTutor explicitly states that the personal safety or other personal interests of home tutors are not within IceCreamTutor’s control. IceCreamTutor accepts no legal responsibility between tutors and parents or students.
1.6 No Guarantee of Long-Term Use of Tutors
IceCreamTutor does not guarantee that parents or students will use tutors for the long term. Tutors using the website’s services must evaluate risks or other personal interests themselves. All individuals must be aware of the risks involved in transactions with individuals who are not of legal age, provide false reasons, or lack contractual capacity.
1.7 Non-Guarantee of Member Identity
IceCreamTutor cannot and will not verify the identity of every member. Therefore, you acknowledge that when dealing with other members shown by IceCreamTutor, you must be cautious to guard against deceptive behavior. IceCreamTutor accepts no responsibility for the actions or omissions of any user.
1.8 Non-Guarantee of Data Accuracy
IceCreamTutor cannot control the data provided by members through the website. Therefore, IceCreamTutor does not guarantee the accuracy of any data provided by individuals using the service.
1.9 Exclusion of IceCreamTutor’s Legal Liability
In the event of any disputes between members or arising from the use of the service, IceCreamTutor disclaims all liability for any legal responsibilities, claims, demands, or compensation (whether tangible or intangible), regardless of nature, known or unknown, suspected or not, disclosed or undisclosed, related to or arising from such disputes.
1.10 Privacy of Personal Data
We are committed to providing you with the best service and respecting your personal privacy. Therefore, when collecting, maintaining, and using personal data, we promise to comply with the requirements of Hong Kong Ordinance Chapter 486, “Personal Data (Privacy) Ordinance.”
1.11 Private Messages
In general, we do not access the content of users’ private messages (PM). However, we reserve the right to access users’ private messages during investigations of suspected violations of these Terms of Use.
IceCreamTutor Rights
2.1 Right to Suspend or Terminate User Qualifications
IceCreamTutor reserves the right to suspend or terminate user qualifications without compensation if users engage in the following behaviors:
(a) Violating the conditions and terms listed in these terms.
(b) Engaging in fraudulent activities related to this website through conviction, settlement, insurance or trust investigations, or other means.
2.2 Right to Handle Provided Data
IceCreamTutor has the absolute and unrestricted right to refuse or delete any data provided by users without notice or compensation to any party. Without prejudice to this right, if any data provided by a member is published or continued to be published, causing IceCreamTutor to incur any legal liability to third parties or violating any laws or rules of any valid jurisdiction or third-party rights, IceCreamTutor reserves the right to refuse or modify any data provided.
2.3 Right to Withdraw Platform Services
IceCreamTutor has the absolute and unrestricted right to withdraw any service conditions without notifying tutors or providing compensation. Without detracting from this right, IceCreamTutor has the right to withdraw services in the following circumstances:
(1) The member provides personal data that is highly likely to be incorrect.
(2) The member is found to violate the conditions and terms listed in these terms or their account is suspended by IceCreamTutor according to these terms.
(3) IceCreamTutor cannot verify or confirm any data provided by the member for any reason.
2.4 Right to Refuse Service
IceCreamTutor has the right to stop providing services to any member and reserves the right to refuse any individual’s application to become a member or terminate the membership of any individual without explanation.
2.5 Right to Add or Remove Terms
IceCreamTutor reserves all rights to add or remove terms at any time without prior notice to members. Members must regularly review the terms to ensure awareness of the latest membership obligations.
2.6 IceCreamTutor’s Expenses
If IceCreamTutor incurs any costs arising from your requests or instructions made in any litigation in which you are involved (whether through a subpoena or any order issued by a court of competent jurisdiction, including compliance with any disclosure document laws or attending court as a witness), including expenses incurred when seeking legal or other professional advice, you shall bear all such costs. (In all such cases, expenses are calculated based on actual losses.)
Terms Related to Tutor Matching Platform Services
3.1 Basic Responsibilities of Members
You agree to authorize this site to use your “registration and publication data” for promotional purposes without limitation by any laws. You also agree that this site may display “registration data” in part or in full when necessary, without limitation by any copyright laws, for promotional purposes. You agree to this site using or copying any part of your “registration data” for promotional purposes. The registration data refers to any data provided by members when registering for services, posting jobs, or searching for jobs. These include, but are not limited to, telephone numbers, email addresses, addresses, and other personal information.
3.2 IceCreamTutor does not guarantee any tutoring services provided by tutors.
The member understands and agrees that IceCreamTutor does not have control over the legality, quality, or risks of tutor services provided by tutors and is not responsible for the legality, quality, or risks of the tutor services provided by tutors.
3.3 Members are responsible for their own actions.
Members are solely responsible for their actions and should exercise caution and common sense when using the site.
3.4 IceCreamTutor does not control the content posted by members.
IceCreamTutor does not control the content posted by members and is not responsible for any loss or damage resulting from such content.
3.5 Members must abide by the law.
Members must abide by all applicable laws and regulations when using the site.
3.6 Members must respect intellectual property rights.
Members must respect the intellectual property rights of others and should not post copyrighted material without permission.
3.7 Members must respect the privacy of others.
Members must respect the privacy of others and should not post personal or confidential information without permission.
3.8 IceCreamTutor reserves the right to remove content.
IceCreamTutor reserves the right to remove any content that violates these terms or is otherwise objectionable.
Dispute Resolution
Any disputes arising from or in connection with these terms shall be resolved through friendly negotiation. If negotiation fails, the parties agree to submit the dispute to the Hong Kong International Arbitration Center for arbitration in accordance with its arbitration rules in effect at the time of applying for arbitration. The arbitral award is final and binding on both parties.
Acceptance of Terms
By registering as a member of IceCreamTutor, you signify your acceptance of these terms and agree to abide by them. If you do not agree with these terms, please do not register or use IceCreamTutor’s services.
